한글·영문·이니셜·한자… 이름 4건 정식 상표로 등록

이번에 등록된 '조용필' 등 4개 상표의 해당 업종은 연예인매니저업·스포츠선수 매니저업·여론조사업·마케팅서비스업, 경매서비스업·음반 소매업·악기와 서적 구매대행업 등 14개다.
하지만 조용필은 음반(업)·전자제품·서적·잡지·문구·의류·공연기획업·전시업 등 70여개의 업종과 상품에 대해서도 똑같이 상표 출원을 했으며, 현재 등록 절차가 순조롭게 진행되고 있어 '조용필'의 이름을 걸고 함부로 할 수 없는 일의 범위는 늘어날 전망이다.
상표가 등록되면 조용필 측은 무단으로 자신의 이름을 도용해 물건을 팔거나 사업을 벌이는 사람에게 민·형사상 책임을 물을 수 있다. 조용필 측은 자신의 의사와 상관없이 옛 음원들을 복각해 음반으로 내서 이익을 챙기는 등 '도의'를 지키지 않는 사업자들의 행위에 대응하는 차원에서 상표 등록을 추진해온 것으로 알려졌다.
사건의 본류와는 별도로 전국의 유흥업소에서 '조용필' 명찰을 달고 홀을 누비는 웨이터들의 '앞날'도 관심사로 떠오를 전망이다. 특허청 관계자는 "등록상표 업종에 음악공연업은 포함이 돼있지만 유흥주점업은 없다"며 "'조용필' 웨이터의 영업을 규제하기는 쉽지 않아 보이지만, 최소한 조용필 아닌 사람이 조용필 이름을 걸고 무대에 오를 순 없게 될 것"이라고 전망했다.
조용필은 이번 4건을 포함해 지난해 5월부터 자신과 관련된 35개의 이름을 상표로 출원해왔다. 이 중엔 밴드 이름인 '위대한 탄생'으로 출원된 5건도 있지만 상표로 등록될 가능성은 높지 않아 보인다. 같은 이름의 오디션 프로그램을 방송했던 MBC가 '스타오디션 위대한 탄생'이라는 이름으로 선점(先占)하는 바람에 등록 거절이 예고됐기 때문이다.
특허청이 고민 중인 것은 조용필이 올해 5월 새 앨범 타이틀곡을 상표 이름으로 출원한 'Hello'다. 특허청 관계자는 "상표로 등록할지에 대해 오랜 논의가 필요할 것 같다"고 말했다.

사실 조선일보 기자가 제목을 이상하게 뽑긴 했어요.
오빠 혼자만 조용필이란 이름을 가진 것도 아니고 다른 조용필은 어쩌라고?? 하면서 기사 읽었는데
다들 기사를 제대로 안 읽었는지 기사만 대충 읽어도 지구에서 지들 맘대로 음반 발매는 못하겠구나 잘 된 일이네 했는데
우리야 단순하게 생각하는거고 일반인들은 다른 조용필이란 이름을 쓰는 분들까지 포괄적으로 생각해서 그러나 보네요.
팬의 입장에선 정말 잘 하셨다 생각합니다.
